Terms of Service
Effective date: Pending — not yet in effect
This is a pre-launch draft and will be finalized before public launch.
1. Agreement to these Terms
Patrimonio is operated by Patrimonio LLC, an Oregon limited liability company (“Patrimonio,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of the Patrimonio website, applications, and services (collectively, the “Service”). By creating an account, clicking to accept these Terms, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for personal, household use by consumers.
2. What Patrimonio is — and is not
Patrimonio is a self-service software tool that helps families plan and manage shared living arrangements. It includes a Housing Financial Planner that produces estimates and projections from information you enter, and a Family Expense Manager that helps you track shared household expenses and contributions.
Patrimonio provides estimates and organizational tools only. It does not provide financial, investment, mortgage, lending, tax, accounting, legal, or real-estate advice, and using it does not create any professional-client, fiduciary, or advisory relationship.
We are not a lender, mortgage broker, loan originator, financial advisor, tax advisor, accountant, or law firm. All outputs — including debt-to-income (DTI) ratios, reverse-mortgage (HECM) proceeds, rental or short-term-rental income projections, construction-loan figures, property values, and any downloadable summary document — are estimates generated from the inputs you provide, are not guarantees, and will differ from figures a lender, tax professional, or other qualified professional calculates using verified documentation. You are solely responsible for verifying all figures with qualified, licensed professionals before making any decision, and you use the Service and rely on its outputs at your own risk.
Any summary document you generate is a planning aid only. It is not a loan estimate, pre-approval, commitment to lend, or an offer of credit, and it is not prepared by or on behalf of any lender.
Short-term rentals and accessory dwelling units are restricted or prohibited in many jurisdictions and by some homeowners’ associations and leases. Patrimonio does not evaluate whether any use is permitted in your location. You are responsible for confirming local laws, zoning, permitting, and any HOA or lease rules.
3. Your account
You must provide accurate information and keep it current. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. Households may invite additional members and assign roles; the household owner is responsible for managing access and for the conduct of members they invite.
4. Subscriptions, billing, auto-renewal, and cancellation
Patrimonio offers paid subscription plans and a limited-time free trial. Current plans, prices, and any trial terms are shown at checkout and on our pricing page. Paid plans are billed in advance through our third-party payment processor. By subscribing, you authorize us to charge your payment method the applicable fee. When a free trial ends, continued access to paid features requires a paid subscription.
Automatic renewal. Paid subscriptions automatically renew at the end of each billing period (monthly or annual, as selected) at the then-current price, and your payment method will be charged, until you cancel. We present the renewal terms, price, and billing frequency before you subscribe and obtain your affirmative consent, and we send any renewal or price-change notices required by law.
Cancellation. You may cancel at any time, easily and through the same online account you used to subscribe — no phone call, email, or retention hurdle required. When you cancel, your paid access continues until the end of the current billing period and does not renew.
Refunds. Subscriptions are not refunded or pro-rated. Cancelling stops the next renewal; it does not refund the period you are in, and you keep your paid access until that period ends. If you close your account outright rather than cancelling, access ends when we process the closure and the remainder of the period is not refunded.
Price changes. We may change prices; changes apply to the next billing period after we provide notice as required by law.
Pausing. Where we offer it, you may pause a subscription instead of cancelling. While paused you are not billed and are not charged afterwards for the months you were away; your access drops to the free plan and your data is left untouched. A single pause can run for up to six months, and you can come back and extend it if you need longer.
5. Listing a practice in Find Help
This section applies only if you list a practice. Nothing in it changes the rest of these Terms.
What you tell us must be true. You represent that the credential you give us is current, is yours, and is in good standing with the body that issued it, and that everything on your listing accurately describes the services you actually provide. You will tell us promptly if any of that stops being true.
If you work inside a client’s home. For those categories you additionally represent that you carry current liability insurance and are bonded, and that every person who attends a client’s home on your behalf has passed a criminal background check before their first visit. That statement is a representation you are making to us and to the families who read your listing, and we may say on your listing that you made it. Making it falsely is a material breach of these Terms.
What we check, and what we do not. Before your listing goes live we confirm your credential against the relevant public register. We do not verify your insurance, we do not run background checks on you or your staff, and we are not a consumer reporting agency. You must not describe yourself as vetted, screened, endorsed, or approved by Patrimonio beyond the credential check we actually performed.
Re-checks. We re-check credentials periodically, and your listing may be taken down until a re-check is complete or until current insurance is on file.
Removal. We may pause or remove a listing at any time, and will do so immediately where we believe a family may be at risk. Where we remove a listing for breach of these Terms, your subscription is cancelled at once and the remainder of the period is not refunded. We may decline to list you again.
A listing is not a referral. We do not employ you, supervise your work, or take any part in what you agree with a family. You are solely responsible for the services you provide and for your own licensing, insurance and compliance.
6. Acceptable use
You agree not to use the Service for any unlawful purpose; misrepresent information to a lender or third party; reverse engineer, scrape, or resell the Service; upload malicious code; infringe others’ rights; or attempt to access data that is not yours. You agree to use the Service only for your own household’s planning and management.
7. Your content and data
You retain ownership of the information you enter (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate the Service and to provide it to the household members and recipients you designate. You are responsible for the accuracy of Your Content and for having the right to share any information about other people that you enter. Our handling of personal information is described in the Privacy Policy.
The journal. A journal entry is stored only so it can be shown back to the person who wrote it. We do not read it, we do not use it for any other purpose, and we do not share it with anyone — including other members of your own household.
We do not train on your content. We do not use Your Content to train artificial-intelligence models, and we do not sell or license it to anyone who would.
8. Intellectual property
The Service, including its software, design, and content (excluding Your Content), is owned by Patrimonio and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal purpose. “Patrimonio” and our logos are our marks and may not be used without permission.
9. Third-party services
The Service relies on third parties (including our payment processor and hosting and infrastructure providers) and may link to third-party sites or professionals. We are not responsible for third-party services, and your use of them is governed by their terms.
10. Disclaimer of warranties
The Service and all outputs are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate or projection is accurate, complete, or suitable for your situation. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, Patrimonio and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, savings, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service or any reliance on its estimates or outputs, even if advised of the possibility of such damages. In particular, we are not liable for any financial, lending, tax, real-estate, or other decision you make based on the Service. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless Patrimonio from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right, including information you enter about other people or share with third parties.
13. Governing law and disputes
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. We will try to resolve any dispute informally first — please contact us before filing a claim. Consumer-protection and privacy laws of your home state may also apply.
14. Changes to the Service and to these Terms
We may modify or discontinue features at any time. We may update these Terms; if we make material changes, we will provide notice as required by law and update the effective date. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service and cancel any subscription.
15. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms or for other lawful reasons. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.
Households nobody uses. If nobody signs in to a household for two years, we schedule it for deletion and everything in it is removed. We do not do that quietly: warning emails begin two months beforehand and repeat, and simply signing in is enough to stop the clock and reset it. A household with a paid subscription is never deleted for inactivity, however long it sits unopened. Inactivity is measured across the whole household rather than per person, so one member who never signs in does not put everyone else's plan at risk. A scheduled deletion can be cancelled during the grace period described in the Privacy Policy.
